RETURN AND EXCHANGE OF GOODS
1. GENERAL PROVISIONS
1.1. These Rules for the return and exchange of goods (hereinafter – the Rules) establish the mutual rights, obligations, and responsibilities of the person who has purchased goods via the online store www.brasa.lt, in the UAB “Brasa” showroom, or through email communication with a UAB “Brasa” sales representative (hereinafter – the Buyer), and UAB “Brasa” (hereinafter – the Seller), when returning or exchanging goods acquired from UAB “Brasa”. By purchasing goods, the Buyer confirms their agreement to be bound by these Rules.
2. RETURN OF GOODS OF SATISFACTORY QUALITY,
in accordance with the Civil Code of the Republic of Lithuania and Resolution of the Government of the Republic of Lithuania (2014-07-22) on the Approval of Retail Trade Rules, as well as the Retail Trade Rules themselves.
2.1. Goods of satisfactory quality may be returned at the Buyer’s expense within 14 calendar days, provided that:
2.1.1. the returned item is in its original and undamaged packaging;
2.1.2. the item is unused, unassembled, and undamaged;
2.1.3. the item has retained its commercial appearance (labels are intact, protective film has not been removed, bags and similar packaging remain untouched);
2.1.4. the returned item is complete with all documentation and any warranties provided by the manufacturer, if applicable.
2.2. When returning a product, the Buyer shall:
2.2.1. provide proof of purchase (receipt, invoice, or bank statement);
2.2.2. complete a request form for return or exchange;
2.2.3. obtain confirmation from the Seller that the product may be returned or exchanged.
2.3. A product of satisfactory quality shall be exchanged, or the amount paid refunded:
2.3.1. If returned in person to the UAB “Brasa” showroom – the refund is issued immediately;
2.3.2. If purchased via the online store www.brasa.lt – the refund is transferred to the Buyer’s account upon receipt and evaluation of the returned item (this process may take up to 5 business days following receipt);
2.3.3. If the refund is to be transferred to an account other than the Buyer’s, a power of attorney issued by the Buyer, authorizing the third party to receive the refund, must be submitted.
2.4. Goods of satisfactory quality shall not be returned or exchanged if:
2.4.1. the items are electrical or other goods specified in Clause 17 of the Retail Trade Rules, which establish a list of non-returnable items;
2.4.2. the goods have been delivered according to the Buyer’s individual order, produced specifically for the Buyer, or are cut-to-measure items (in such cases, only full, unopened packages of cut-to-measure goods may be returned);
2.4.3. the goods are evidently damaged, have lost their commercial value, have had protective films removed, have damaged packaging, or have been partially or fully assembled.
3. RETURN OF DEFECTIVE GOODS,
in accordance with the Civil Code of the Republic of Lithuania and Resolution of the Government of the Republic of Lithuania (2014-07-22) on the Approval of Retail Trade Rules, as well as the Retail Trade Rules themselves.
3.1. Defective goods may be exchanged or returned during the warranty period provided by the manufacturer, but no later than two years from the date of purchase.
3.2. When returning defective goods (or submitting evidence confirming the defect), the Buyer must present them for quality evaluation at a UAB “Brasa” showroom.
3.3. In the event that a defective item is returned, and no damages or signs of improper assembly are identified, the Seller undertakes to replace the item with one of satisfactory quality at their own expense or refund the amount paid by the Buyer.
